Validity of severance provisions in professional partnership agreements as impermissible termination restrictions under § 723 Abs. 3 BGB
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Civil Procedure (BGH) dismissed the plaintiff's complaint against the non-admission of revision, thereby upholding the lower court's judgment and leaving the defendant's position intact regarding the interpretation of a provision in a professional partnership agreement. The dispute concerned the validity of a pension and severance scheme for withdrawing partners, where the plaintiff argued that a specific interpretation of the provisions was impermissible. The court ruled that the appeal lacked merit, as the appellate court correctly found that the challenged interpretation constituted an impermissible limitation on the right to terminate the contract under § 723 Abs. 3 BGB. The BGH determined that neither questions of fundamental significance nor a need for uniform case law were present to justify a second instance review at the highest civil court level.

Halbsatz ZPO abgesehen.
Die Klägerin trägt die Kosten des Beschwerdeverfahrens (§ 97 ZPO).
