The Federal Court of Justice (BGH) dismissed the defendant's revision against the Landgericht Krefeld's judgment of January 15, 2010, upholding the conviction and the applied sentencing framework. The case concerned the correct application of the reduced sentencing provisions for drug offenses where the offender provides assistance to the investigation (Aufklärungshilfe), specifically whether the old or new version of the law applied following a legislative amendment effective after the opening of the main trial. The court held that the Landgericht correctly applied the prior version of § 31 No. 1 of the Narcotics Act in conjunction with § 49(2) of the Criminal Code, as this constituted the milder law under § 2(3) of the Criminal Code given that the sentencing court had positioned the sentence at the lower end of the statutory range. The BGH explicitly overruled a prior procedural assumption that the new regulation must always apply if the main trial opens after August 31, 2009, reaffirming that the choice between old and new law depends on which provision is more favorable to the defendant.

Aufklärungshilfe des Täters des Betäubungsmitteldelikts: Nach Gesetzesänderung anzuwendende Gesetzesfassung der Strafmilderungsvorschrift

[TENOR]
