Inadmissibility of revision complaint due to lack of subject-matter jurisdiction and non-compliance with attorney representation requirements
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the appellant's complaint against the non-admission of revision as inadmissible, ordering the appellant to bear the costs, thereby leaving the appellate court's judgment upholding the defendant's defense in force. The dispute concerned a civil matter where the appellant sought to challenge the Landgericht Köln's rejection of their appeal on the merits, but the value of the dispute in dispute stood at €4,612, which the lower court determined was insufficient to permit revision. The decisive legal basis was § 26 No. 8 EGZPO, which requires the value of the dispute to exceed €20,000 for revision to be admissible, alongside a procedural violation under §§ 78, 544 ZPO because the complaint was not filed by a lawyer admitted to practice at the Federal Court of Justice.

Beschwerde gegen die Nichtzulassung der Revision
[TENOR]
