The Federal Court of Justice (BGH) denied the applicant's request for legal aid to file a complaint against the non-admission of a legal appeal (Rechtsbeschwerde), ruling that the intended litigation had no prospect of success. The dispute arose in a lawyer liability case where the applicant sought to challenge the lower court's decision not to admit a legal appeal, which had been issued in the form of an order (Beschluss) rather than a judgment. The court held that under § 114 Sentence 1 ZPO, legal aid must be refused because the German Code of Civil Procedure exclusively permits a non-admission complaint (Nichtzulassungsbeschwerde) against judgments rendered on appeal under § 544 Sentence 1 ZPO, and explicitly excludes orders or decisions issued in order form. Furthermore, the court determined that the specific provisions of the Labour Courts Act (Arbeitsgerichtsgesetz), including § 92a, which the applicant relied upon, are neither directly nor by analogy applicable to proceedings in lawyer liability cases, and no constitutional requirement mandates an extraordinary complaint path in this context.
