Construction contract surcharge for additional quantities and the rebuttal of presumed moral reprehensibility under § 138 BGB
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the plaintiff's complaint for non-acceptance of revision, rejecting her attempt to challenge the lower court’s judgment, which therefore stands as the final operative outcome in this dispute over construction contract pricing. The case concerned an agreement based on the standard terms and conditions for construction (VOB/B) regarding additional quantities, where the compensation stipulated by the parties exceeded the standard rate by a factor of over eight hundred. The decisive legal basis was § 138 Abs. 1 BGB, under which such an extraordinary premium created a rebuttable presumption of morally reprehensible profit-seeking; the court ruled that this presumption was not successfully rebutted by the plaintiff’s arguments on price formation, leading to the dismissal of the legal complaint and an award of costs to the defendant.
