Cost allocation and procedural dismissal of revocation proceedings for refugee recognition due to naturalization and mootness
Legislator-Zusammenfassung
KI-generiertThe Federal Administrative Court (BVerwG) dismissed the proceedings as effectively concluded and declared the prior judgments of the Bayerischer Verwaltungsgerichtshof and the Munich Administrative Court invalid specifically regarding the revocation of refugee recognition, while maintaining the lower courts' cost orders concerning the revocation of deportation protection and negative determinations under the Residence Act; consequently, the parties' costs for the refugee recognition dispute were mutually offset. The case involved a revocation proceeding challenging the withdrawal of refugee status and related protective statuses, which became moot because the claimant was naturalized, rendering the main subject of the dispute factually resolved. The decisive legal basis included the application of § 92 Abs. 3 VwGO for setting aside the proceedings due to mutual declaration of settlement, § 161 Abs. 2 VwGO for the court's discretion in determining costs, and § 155 Abs. 1 Satz 1 VwGO, which justified the cost offset given that the outcome depended on pending European Court of Justice preliminary rulings and the naturalization was attributable to the claimant's sphere.

Februar 2008 - BVerwG 10 C 33.07 u.a. - abhing.
