Legislator-Zusammenfassung

KI-generiert

The Bundesgerichtshof (BGH) denied the plaintiff's application for legal aid, thereby upholding the lower court's dismissal of the challenge to paternity. The dispute concerned a paternal challenge to established paternity where the biological father did not reside with the child, requiring the court to assess whether a "social-familial relationship" existed to satisfy the procedural prerequisites for such an action. The decisive legal basis was Section 1600 Paragraph 4 Sentence 1 of the German Civil Code (BGB), which the court clarified protects non-cohabiting fathers who bear actual responsibility for the child, per the basic right protected by Article 6 Paragraph 1 of the German Basic Law; the court found that the plaintiff's intended legal action lacked a sufficient prospect of success under Section 114 Paragraph 1 Sentence 1 of the Code of Civil Procedure (ZPO).

BVerfGE 108, 82, 112 = FamRZ 2003, 816, 822; 2006, 1596, 1597).
