Inadmissibility of family law legal complaint for failure to substantively argue against procedural agent fee fixed allowance
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) dismissed the legal appeal (Rechtsbeschwerde) as inadmissible and ordered that no court costs be levied. The dispute concerned the remuneration of a procedural custodian (Verfahrensbeistand) in family law proceedings, specifically challenging the fixation of a flat-rate compensation allowance by a district revisor. The appeal was rejected on procedural grounds because it failed to meet the statutory requirements for substantive justification under § 71 Abs. 2 and 3 FamFG; the court held that a mere reference to the case file and prior submissions did not constitute a proper legal argumentation, rendering the appeal unallowed irrespective of questions regarding the revisor's capacity to represent parties before the BGH.

BGH Urteil vom 24. Januar 2000 - II ZR 172/98 - NJW 2000, 1576 [Revisionsbegründung]; Keidel/Meyer-Holz FamFG 16. Aufl. § 71 Rdn. 36; Bork/Jacoby/Schwab/Müther FamFG § 71 Rdn. 20).
