Asylum applicant selection from definable group for suspected separatist support and denial of due process as elements of political persecution
Legislator-Zusammenfassung
KI-generiertThe Federal Administrative Court (BVerwG) dismissed the plaintiff's complaint against the non-allowance of revision, ordering the plaintiff to bear the procedural costs, thereby upholding the decision of the Higher Administrative Court of North Rhine-Westphalia. The case involved a challenge to the rejection of an asylum application, where the applicant argued that being "selected" from a definable group by a persecuting state for suspected support of a separatist movement, followed by a lack of due process and the threat of torture, constituted political persecution. The court found the complaint unsuccessful because it failed to demonstrate the essential significance of the raised legal question or the existence of procedural errors, specifically noting that the lower court had already determined there was no concrete indication linking the plaintiff to the separatist organization, rendering the abstract legal question irrelevant to the outcome. The decision was based on §§ 132(2) No. 1 and 3, 133(5) Sentence 2, and 154(2) of the Administrative Procedure Act (VwGO), § 83b of the Asylum Procedure Act, and § 30 of the Legal Services Act.

2 VwGO).
Die Kostenentscheidung beruht auf § 154 Abs. 2 VwGO. Gerichtskosten werden gemäß § 83b AsylVfG nicht erhoben. Der Gegenstandswert ergibt sich aus § 30 RVG.
