Scope of political persecution in asylum: singling out separatism suspects without due process decisive for appeal leave
Legislator-Zusammenfassung
KI-generiertThe Federal Administrative Court (BVerwG) rejected the plaintiff's complaint against the non-allowance of leave to appeal a judgment by the Higher Administrative Court of North Rhine-Westphalia, thereby upholding the lower court's decision and ordering the plaintiff to bear the costs of the complaint proceedings. The dispute concerned an asylum application where the plaintiff challenged the rejection of his claim based on allegations of political persecution in Sri Lanka, specifically asserting that being singled out from a determinable group on suspicion of supporting separatist movements, followed by rights-violating detention and torture, constituted political persecution. The BVerwG denied leave to appeal, finding that the plaintiff failed to demonstrate the general significance of the raised legal question regarding the definition of political persecution because the lower court had already established that the plaintiff was not suspected of being close to the specific separatist organization and could be quickly identified via his valid passport, rendering the abstract legal question non-decisive for the outcome. The court relied on § 132 Abs. 2 VwGO for the standards of review, waiving further detailed reasoning under § 133 Abs. 5 VwGO.

2 VwGO).
Die Kostenentscheidung beruht auf § 154 Abs. 2 VwGO. Gerichtskosten werden gemäß § 83b AsylVfG nicht erhoben. Der Gegenstandswert ergibt sich aus § 30 RVG.
