Valuation of psychiatric expert testimony as witness evidence without prior oath and instruction
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice (BGH) rejected the prosecution's appeal as inadmissible and the defendant's appeal as unfounded, thereby upholding the lower court's judgment. The dispute centered on whether the trial court erred in utilizing a psychiatric expert's testimony regarding additional facts without first administering the required oath and instructions for witness testimony. While the court clarified that such procedural objections are admissible as a procedural appeal, it held that the error did not affect the outcome, reasoning that the expert would likely have provided identical testimony had they been treated as a witness, and the evidence evaluation would not have been more favorable to the defendant. The decision rests on §§ 349(1) and 349(2) of the Code of Criminal Procedure (StPO) and precedents regarding the admissibility of expert-witness hybrid testimony and the requirement for a favorable evidentiary outcome to justify reversal.

BGH NStZ 1985, 135).
