The Federal Court of Criminal Justice confirmed the transfer of jurisdiction, ordering that the local court at the defendant's new residence assume responsibility for the investigation and adjudication of the juvenile criminal proceedings, thereby upholding the prior instance's decision. The dispute concerned the procedural venue for a juvenile case following the defendant's relocation from the initial jurisdiction to a new district after the indictment had been filed, raising questions about the appropriateness of transferring the case to accommodate the defendant's move and the involvement of local youth welfare services, despite witnesses remaining in the original jurisdiction. Relying on Section 42(3) of the Youth Court Act, the court determined that the transfer was admissible due to the defendant's change of residence post-indictment and necessary for the efficient participation of the youth court welfare office in the new district, concluding that the logistical inconvenience to witnesses in the former jurisdiction was of subordinate importance.

Senat, Beschluss vom 7. Februar 2007 - 2 ARs 547/06).
