Legislator-Zusammenfassung

KI-generiert

A trade association representing health insurers filed a claim against former members regarding unpaid contributions. The court ruled that while the claimant was an association, the dispute, based on federal law concerning health insurance, fell under the jurisdiction of the cantonal social insurance court. The court determined that disputes between insurers, as defined by federal law, are handled by the social insurance court of the canton where the defendant insurer is located, and this principle extended to the association's claim. The court deferred ruling on claims stemming from administrative contracts, noting that if these were purely private law matters, they would also not fall under the administrative court's purview, ultimately forwarding the case to the social insurance court.

--- · --- · --- · Geschäftsnummer: · VK.2018.00007 · Entscheidart und -datum: · Endentscheid vom 27.06.2019 · Spruchkörper: · 3. Abteilung/3.
