Legislator-Zusammenfassung

A student failed to meet the promotion requirements in the fourth grade of a secondary school and was only provisionally promoted to the next semester. The court upheld the provisional promotion decision, reasoning that the teacher acted within their discretionary authority under the relevant regulations when weighting oral participation at one-third relative to written performance, and that the student had sufficient opportunity to influence their participation grade despite absences. Furthermore, the court found no special circumstances justifying an exception to the promotion rules, and the fact that the student was currently attending the fifth grade due to the suspensive effect of the appeal was deemed irrelevant to the legality of the initial decision.
