Deportation Detention Extension During COVID-19 Pandemic
Legislator-Zusammenfassung
KI-generiertThe court addressed the judicial approval for the extension of an individual's deportation detention, focusing on procedural rights, executability, and proportionality during the COVID-19 pandemic. The court reasoned that while an oral hearing is generally mandatory for such extensions, the specific circumstances of the pandemic constituted an exceptional situation where the detainee's waiver of the hearing was permissible, thus not violating the right to be heard. Furthermore, while the pandemic created increased uncertainty, the court found that the underlying deportation order was not impossible to execute and that the detention, considering all factors including the family situation, remained proportionate at that time, leading to the dismissal of the challenge.
