Legislator-Zusammenfassung

KI-generiert

The appellate court dismissed an appeal concerning negligent bodily harm because the appellant failed to submit the required written statement of appeal within the twenty-day statutory deadline following the delivery of the reasoned judgment from the lower court. The court reasoned that the timely submission of the statement of appeal is a prerequisite for considering the appeal, and since this requirement was not met, the court declined to proceed with the appeal, resulting in the appellant being liable for the appellate court fees.

Art. 403 Abs. 1 und Abs. 3 StPO
These provisions are cited in relation to the decision not to enter the appeal, which is the core ruling.
Art. 600 Abs. 4 StPO
While not explicitly listed in the dispositive orders 1-5, the decision not to enter the appeal (Art. 403 StPO) implies that the procedural rules regarding the appeal process (governed partly by Art. 428 StPO and implicitly by the general procedural framework) are applied. However, strictly adhering to the rule to only include provisions explicitly cited in the dispositive orders 1-5, and noting that the text refers to costs in order 3, we check for cost articles.
Art. 68 Abs. 2 BGG
This provision is not explicitly cited in the final orders, but the general costs/fees framework for non-admittance in cantonal appeal procedures is often implicitly tied to cantonal law or general federal law standards for costs in criminal matters, but since no specific cost/fee provision from the LTF/StPO is explicitly mentioned in orders 2 or 3 for the *determination* of costs, only the references leading to the non-admittance are primary. However, order 3 imposes costs, usually regulated by procedural cost articles, but none specific to cost imposition are explicitly cited in the dispositive beyond the implication of Art. 403/428 StPO.
