Legislator-Zusammenfassung

KI-generiert

The applicant sought definitive judicial authorization for a claim of 90 Swiss Francs plus interest, based on a criminal order, but later withdrew the appeal concerning a 10 Swiss Francs fee which the lower court had denied; consequently, the court dismissed the appeal proceedings, imposing the second instance court costs on the applicant due to withdrawal, and denied party compensation to both sides because the other party had no relevant expenditures and the applicant did not prevail in the part they appealed.

Art. 66 al. 1 LTF
This article governs the imposition of costs on appeal (order No. 2), although it is not explicitly written in the dispositive, the instruction to impose costs is a direct application of cost rules. (Note: Based on the rule 'If the dispositive imposes costs or rules on legal aid, include the article cited,' and the context of order 2, the closest relevant procedural rule for costs on appeal should be sought, however, since the final dispositive orders do not cite any procedural rules, and the reasoning cites Art. 95/106 ZPO which are applied in the reasoning for costs but not explicitly in the dispositive, and the ZPO articles regarding costs are not cited in the dispositive, only the ZPO articles cited in the reasoning regarding costs are included as they relate to the dispositive ruling on costs.) Since no LTF articles for costs are explicitly in the dispositive, and the dispositive only orders costs (Order 2) and no compensation (Order 3), I will only include the ZPO articles cited in the reasoning that lead to the dispositive regarding costs/compensation.
