Vexatious Appeal in Debt Enforcement Proceedings Dismissed
Legislator-Zusammenfassung
KI-generiertA party appealed a payment order in debt enforcement proceedings without indicating the basis for the appellate court's jurisdiction, which, in such matters, generally lies with the District Court as the first instance of supervision. Furthermore, the appeal was submitted again without the required power of attorney for the represented spouse, and given the appellant's extensive litigation history, the court found the appeal vexatious. Consequently, the court dismissed the appeal as inadmissible and ordered the appellant to bear the costs of the frivolous proceedings.

Nov. 12 = ZR 111/2012 Nr. 89, Josef A. betreffend).
5 SchKG).
