The appellate court addressed a debtor's appeal against the opening of bankruptcy proceedings, where the debtor asserted they had settled the creditor's claim, including interest and collection costs, as well as court fees, prior to the initial bankruptcy order. The court reasoned that under the relevant statute, it could consider new facts on appeal, specifically the pre-judgment payment of the debt and associated costs, which would have mandated the rejection of the bankruptcy request had the lower court been aware. Finding documentary proof that the debtor had indeed paid the debt and all requisite costs before the appeal decision, the court upheld the principle of setting aside a bankruptcy declaration based on such a successful, albeit late, satisfaction of the debt, thus overturning the initial bankruptcy order, while imposing all procedural costs of both instances on the debtor for having unnecessarily initiated the proceedings.

Urteil vom 5. September 2011

in Sachen

A._____ GmbH, Schuldnerin und Beschwerdeführerin,

gegen
