A litigant filed an appeal against a lower court's decision requiring them to pay a security deposit of CHF 6,950.00 for a lawsuit concerning termination protection and extension in a tenancy dispute, arguing they lacked the financial means and were receiving social assistance. The higher court dismissed the appeal, reasoning that while the requirement to pay a security deposit is subject to appeal, the litigant's challenge was essentially a request for exemption based on financial hardship (free legal aid), which must first be submitted to the court handling the main proceedings, not the appellate court. Consequently, the matter was forwarded to the lower court for processing as a formal application for the waiver of court fees.

Beschluss vom 23. März 2023

in Sachen

1. A._____,

2. ... Klägerin und Beschwerdeführerin

gegen

1 ZPO i.V.m. Art. 103 ZPO).

Art. 117 lit. a ZPO und Art. 119 Abs. 2 ZPO).
