Legislator-Zusammenfassung

KI-generiert

An individual, previously subject to custodial care and emergency psychiatric transfer, filed a motion seeking release from an acute psychiatric facility and cessation of involuntary medication, but subsequently discharged themselves from the facility before the lower court ruled. The lower court dismissed the motion as moot, leading the individual to appeal this procedural decision. The appellate court determined that the appellant was no longer aggrieved by the mootness declaration because the underlying issues—their detention and involuntary medication—were resolved by their departure, meaning the requisite legal interest for pursuing the appeal was lacking, resulting in the dismissal of the appeal without cost allocation.

Art. 90 BGG
Cited to establish that the decision is a final decision for the purpose of appealing to the Federal Supreme Court.
Art. 72 ff. BGG
Cited in relation to the admissibility of a potential appeal to the Federal Supreme Court (implied procedural framework for appeal).
Art. 113 ff. BGG
Cited in relation to the admissibility of a potential subsidiary constitutional appeal to the Federal Supreme Court (implied procedural framework for appeal).
Art. 42 BGG
Cited in conjunction with appeal provisions regarding the formal requirements for lodging an appeal to the Federal Supreme Court.
Art. 66 al. 1 LTF
Although not explicitly cited in the dispositive, the instruction is to include cost provisions. The decision explicitly states in order 2 that no costs are levied ('Es werden keine Kosten erhoben'). In Swiss practice, this often relates to Art. 66 LTF (or Cantonal equivalent), but since only specific articles cited in the dispositive are allowed, and no explicit cost provision is cited in orders 1-4, we must rely only on explicit citations. However, examining order 5, it cites BGG articles, not LTF articles regarding costs.
Art. 68 al. 2 BGG
This article is typically cited for awarding party compensation, which is explicitly denied in order 3 ('Es wird keine Parteientschädigung zugesprochen'). Since no specific cantonal procedural article governing costs/compensation is cited in the operative part, and the court only refers to BGG articles for appeal purposes, this court decision does not explicitly cite a *provision* to deny costs/compensation in the dispositive orders 1-4. Therefore, only the explicitly cited BGG articles remain.

Geschäfts-Nr.: PA190035-O/U

Mitwirkend: Oberrichter lic. iur. P. Diggelmann, Vorsitzender, Oberrichterin lic. iur. A. Katzenstein und Oberrichter Dr. P. Higi sowie Gerichtsschreiberin MLaw C. Funck

Beschluss vom 22. Oktober 2019

in Sachen

A._____, Gesuchsteller und Beschwerdeführer,

sowie

B._____ AG,

Verfahrensbeteiligte,
