Appeal Withdrawal and Cost Allocation in Spousal Support Case
Legislator-Zusammenfassung
KI-generiertIn an appeal concerning spousal support payments (Eheschutz), the appellate court dismissed the proceedings because the appealing party withdrew their appeal shortly after filing it. The court reasoned that according to procedural law, the withdrawal necessitates the discontinuation of the appeal proceedings, and consequently, the costs of the appellate proceedings were imposed upon the appellant who withdrew the action, while no party compensation was awarded to the appellee due to a lack of relevant activity in the appeal stage.
