§ 12 GerGebV, Gebühr bei Rückweisung Die Gebühr ist zu reduzieren.

4. Der Festsetzung der Kosten ist der Streitwert von Fr. 368'860.-- gemäss Berufungsantrag zugrunde zu legen. Den Reduktionsgrund der Rückweisung kennt die Gebührenverordnung nicht mehr. In Analogie zum Fall des prozessleitenden Entscheides (§ 7 aGebV OG) ist die Gebühr zu ermässigen. Im vorliegenden Fall ist eine Reduktion auf rund zwei Drittel des ordentlichen Ansatzes angezeigt.
