Incidental Proceeding: Admission of Appeal and Joinder for Indemnification
Synthèse Legislator
Généré par l'IAIn an incidental proceeding stemming from a main dispute between two parties, the instructing judge admitted the appeal request filed by one of the parties and authorized that party to join a third party to the case, seeking that the third party be compelled to indemnify the appellant against any financial condemnation (principal, interest, costs, and fees) they might face in favor of the original opposing party. The court also set a deadline for the newly joined party to potentially summon another person and determined the costs for the incidental procedure, deferring the final allocation of these costs to the outcome of the main case.

Généré par l'IAThis article, likely related to the procedural aspect of interlocutory decisions or simplified procedures, is cited implicitly as the basis for the decision, although the text here is from a Cantonal court, suggesting it might be a misinterpretation or a placeholder for a cantonal procedural rule corresponding to the concept often found under Art. 108 LTF in Swiss Federal Court practice concerning the handling of such incidental rulings. Given the context of an 'incident' ruling, the citation format suggests a procedural basis for the decision's immediate effect or nature, which is a common category for included provisions.
This article is implied in the decision regarding costs ('dépens') allocation in point V.
