The Federal Department of the Environment, Transport, Energy and Communications (DETEC) ruled that the freight rail transport sector, to the extent it falls under the scope of the bilateral agreement on public procurement between Switzerland and the European Community, is not subject to public procurement law. This decision indicates that companies operating in this specific sector are not required to adhere to the standard public procurement regulations when offering their services within the defined scope of the agreement.
