Switzerland Parking Permit Delay Violates Fair Hearing Rights
Legislator-Zusammenfassung
KI-generiertThe European Court of Human Rights found that an eight-year, six-month, and thirteen-day building permit process for parking spaces in Switzerland violated Article 6 § 1 of the European Convention on Human Rights, which guarantees the right to a fair hearing within a reasonable time. The Court determined that the length of the proceedings, from the initial appeal to the final federal court judgment, was unreasonable, regardless of the cantonal government's backlog or the applicants' unauthorized use of the parking spaces during the prolonged period.
