H v. State
Legislator-Zusammenfassung
KI-generiertThe court declared inadmissible a complaint concerning the lack of a public hearing in an appeal against a fine for assault. The court reasoned that while Article 6 of the ECHR generally guarantees a fair trial including public hearings, exceptions for second or third instance proceedings are permissible if justified by the specific nature of the case. In this instance, the appeal focused solely on legal questions, not factual ones, and therefore a public hearing was not required to fulfill the purpose of Article 6, which is to allow public scrutiny of the judiciary. Furthermore, the court found that the offense, a minor contravention punishable by a small fine, fell under the exception to the right of appeal for minor offenses as provided by Protocol No. 7.

Oktober 1991, Serie A 212-A, S. 16, § 36).
Art. 2 § 2 Prot. Nr. 7 EMRK.
giuridiche.
