Legislator-Zusammenfassung

KI-generiert

The European Court of Human Rights declared inadmissible a complaint alleging a violation of the presumption of innocence. The applicant argued that his continued detention was justified based on an existing indictment and confessions from a prior, not yet finalized, proceeding, and that his detention duration was calculated considering the anticipated total sentence from both proceedings, including an unfinalized judgment. The Court found no violation, as considering these elements to assess the risk of reoffending and to determine the maximum permissible pre-trial detention did not contravene the presumption of innocence.
