Fines for Vexatious Litigation and Inappropriate Conduct Not Violative of Fair Trial or Freedom of Expression
Legislator-Zusammenfassung
KI-generiertThe Commission declared inadmissible a request alleging violations of Article 6(1) and Article 10(2) of the European Convention on Human Rights. The applicants complained that fines imposed on them for vexatious litigation and inappropriate conduct before the courts violated their right to a fair trial and access to court. The Commission found that the fines did not violate Article 6(1) and that the fine for inappropriate conduct was a permissible restriction on freedom of expression under Article 10(2), as it was prescribed by law and necessary in a democratic society to maintain the authority and impartiality of the judiciary.

Déc. de la Comm. eur. DH du 2 avril 1992, déclarant irrecevable la req. N° 17417/90, S. et E. c / Suisse
Discipline devant les tribunaux. Art. 6 § 1 CEDH.
27 § 2 CEDH. [145] Cf. également JAAC 56.52.
