Opposante BLEDINA SA, 383 rue Philippe Héron, F-69400 Villefranche sur Saône, enregistrement international no 742 353 blédina (fig.) contre Défenderesse Hofer Kommanditgesellschaft, Hofer Strasse 1, AT-4642 Sattledt, enregistrement international no 848 457 BELLINA. L’Institut Fédéral de la Propriété Intellectuelle a décidé le 17 août 2007 ce qui suit:
1. La défenderesse est exclue de la procédure d’opposition no 7826.
2. La procédure d’opposition no 7826 à l’encontre de l’enregistrement international no 848 457 BELLINA, devenue sans objet, est close par classement.
3. La taxe d’opposition de 800 francs reste acquise à l’Institut.
4. Il n’est pas accordé de dépens.
5. La présente décision est notifiée par écrit à la partie opposante, par publication à la Feuille fédérale pour la partie défenderesse.
Voies de droit: Cette décision peut faire l’objet d’un recours, dans un délai de 30 jours à compter de cette notification, auprès du Tribunal administratif fédéral, 3000 Berne 14.
