Décision dans la procédure d’opposition no 9126
Opposante Guccio Gucci S.p.A., Via Tornabuoni, 73/R, IT-50123 Firenze, enregistrement international no 598 277 «G» (fig.) contre Défenderesse LIN CHAIHUA, Via dell’Olmo, 193, Sesto Fiorentino (Firenze) (IT), enregistrement international no 919 438 «GO» (fig.) L’Institut Fédéral de la Propriété Intellectuelle a décidé le 31 octobre 2008 ce qui suit:
1. La défenderesse est exclue de la procédure.
2. L’opposition no 9126 contre l’enregistrement international no 919 438 «GO»
(fig.) est rejetée.
3. La taxe d’opposition de 800 francs reste acquise à l’Institut.
4. Aucuns dépens ne sont alloués aux parties.
5. Quand la présente décision sera entrée en force, une déclaration d’acceptation de l’enregistrement international no 919 438 «GO» (fig.) sera émise.
6. La présente décision est notifiée aux parties, par publication dans la Feuille fédérale pour la défenderesse.
Voies de droit: Cette décision peut faire l’objet d’un recours, dans un délai de 30 jours à compter de cette notification, auprès du Tribunal administratif fédéral, 3000 Berne 14. Une copie de la présente décision est à joindre au mémoire de recours.
