V., 39, Wegalaan, NL-2130 KC Hoofdorp, Hollande, marque internationale no 718871 LOVABLE MIMESIS, représentée par Jacobacci & Perani SA, 2, avenue de la Gare des Eaux-Vives, 1207 Genève, contre Défendeurs Röttger Wilhelm, Lenz Maximilian, Lenz Fabrian, Jankuhn Klaus, Giesebrechtstrasse 16, DE-10629 Berlin, marque internationale no 750511 Lovenation. Le 13 septembre 2002, l’Institut Fédéral de la Propriété Intellectuelle a décidé ce qui suit:
1. La défenderesse est exclue de la procédure.
2. L’opposition no 5081/2001 contre la marque internationale no 750511 Lovenation est rejetée.
3. La marque internationale no 750511 Lovenation sera définitivement acceptée à la protection en Suisse une fois la présente décision entrée en force.
4. La taxe d’opposition de 800 francs reste acquise à l’Institut.
5. Il n’est pas allouer de dépens.
6. La présente décision est notifiée aux parties; à la partie défenderesse par publication dans la Feuille fédérale.
Voies de droit: La présente décision peut être attaquée par voie de recours dans les 30 jours à dater de sa notification devant la Commission de recours en matière de propriété intellectuelle, Einsteinstrasse 2, 3003 Berne. Les mémoires de recours doivent être présentés en trois exemplaires.
