An opposition was filed against the registration of an international trademark based on a prior Swiss trademark. The defendant in the opposition proceedings was excluded, and the opposition was upheld. The court ruled that the earlier trademark likely caused confusion with the earlier mark, leading to the definitive refusal of the international trademark registration. The defendant was ordered to pay costs and a refund of the opposition fee.
