Décision dans la procédure d’opposition no 5726

Opposant/e Carolina Herrea Ltd,, 501 Seventh Ave. 17th Floor, US-New York (NY 10018), marque suisse no 485080 CAROLINA HERRERA CHIC, représentée par Kirker & Cie, Conseils en Marques SA, 122, rue de Genève, Case Postale 153, 1226 Thônex contre Défendeur Ulric de Varens S.A., 47, rue Boissière, FR-75116 Paris, marque internationale no 771699 CHIC-ISSIME. Le 17 juillet 2003, l’Institut Fédéral de la Propriété Intellectuelle a décidé ce qui suit:

1. La défenderesse est exclue de la procédure.

2. L’opposition no 5726/2002 contre la marque internationale no IR-771699 CHIC-ISSIME est rejetée.

3. La marque internationale no IR-771699 CHIC-ISSIME sera acceptée à la protection en Suisse après l’entrée en force de la présente décision.

4. La taxe d’opposition de 800 francs reste acquise à l’Institut.

5. Aucun dépens n’est alloué à la défenderesse.

6. La présente décision est notifiée aux parties; par publication dans la Feuille fédérale pour la partie défenderesse.

Voies de droit: La présente décision peut être attaquée par voie de recours dans les 30 jours à dater de sa notification devant la Commission de recours en matière de propriété intellectuelle, Einsteinstrasse 2, 3003 Berne. Les mémoires de recours doivent être présentés en trois exemplaires.
