Opposant/e ACE SA société anonyme, F-78280 Guyancourt (France), marque internationale n° R 253 370 (Bel Air (fig.)), mandataire William Blanc & Cie, Conseils en propriété industrielle SA, rue du Valais 9, 1202 Genève 9 contre Défendeur/resse Rafaël Julien Mertens NL-1186 VP Amstel Veen (Pays-Bas), marque internationale n° 724 639 (BELLE AIR (fig.)). Le 7 août 2001, l’Institut Fédéral de la Propriété Intellectuelle a décidé ce qui suit:

1. Le défendeur est exclu de la procédure.

2. L’opposition n° 4271/2000 contre la marque internationale n° 724 639 (BELLE AIR (fig.)) est admise.

3. Dès l’entrée en force de la présente décision, la marque internationale n°

724 639 (BELLE AIR (fig.)) sera définitivement refusée à la protection en Suisse selon les termes de l’avis de refus provisoire du 15 juin 2000.

4. La taxe d’opposition de 800 francs reste acquise à l’Institut.

5. Il est mis à la charge du défendeur le paiement à l’opposante d’une somme de 1800 francs à titre de dépens et de remboursement de la taxe d’opposition.

6. La présente décision est notifiée aux parties, par publication dans la Feuille fédérale pour le défendeur.

Voies de droit La présente décision peut être attaquée par voie de recours dans les 30 jours à dater de sa notification devant la Commission de recours en matière de propriété intellectuelle, Einsteinstrasse 2, 3003 Berne. Les mémoires de recours doivent être présentés en trois exemplaires. Une copie de la décision attaquée sera jointe au recours.
