Arrêté fédéral sur la conversion du crédit de construction du BLS Chemin de fer du Loetschberg SA en prêt conditionnellement remboursable

du 22 mars 2007

L’Assemblée fédérale de la Confédération suisse, vu l’art. 167 de la Constitution1, vu l’art. 56 de la loi fédérale du 20 décembre 1957 sur les chemins de fer2, vu le message du Conseil fédéral du 17 mars 20063, arrête:

Art. 1 Le crédit de construction octroyé au Chemin de fer Berne–Loetschberg–Simplon, aujourd’hui BLS Chemin de fer du Loetschberg SA, par l’arrêté fédéral du 22 juin 19764, d’un montant de 798 455 923,95 francs (état au 1er janvier 2005) est converti en un prêt sans intérêt, conditionnellement remboursable. En cas de besoin, ce prêt peut, en tout ou partie, être converti en capital-actions.

Art. 2 Le Conseil fédéral assure que dans le cadre de la conversion du crédit visée à l’art. 1, la part de la Confédération dans les infrastructures sera suffisamment garantie, autrement dit que la Confédération possédera une participation majoritaire dans une future société d’infrastructures.

Art. 3 Le présent arrêté n’est pas sujet au référendum.
