Loi fédérale Projet sur l’application à titre provisoire de traités internationaux
du
L’Assemblée fédérale de la Confédération suisse, vu le rapport de la Commission des institutions politiques du Conseil des Etats du 18 novembre 20031, vu l’avis du Conseil fédéral du 18 février 20042, arrête:
I Les actes mentionnés ci-après sont modifiés comme suit:
1. Loi du 21 mars 1997 sur l’organisation du gouvernement et de l’administration3
Art. 7b (nouveau) Application à titre provisoire de traités internationaux par le Conseil fédéral
1 Si l’Assemblée fédérale est compétente pour l’approbation d’un traité international, le Conseil fédéral peut décider ou convenir de son application à titre provisoire si la sauvegarde d’intérêts essentiels de la Suisse et une urgence particulière l’exigent.
2 Si, dans un délai de six mois à compter du début de l’application à titre provisoire, le Conseil fédéral n’a pas soumis à l’Assemblée fédérale le projet d’arrêté fédéral portant approbation du traité concerné, ladite application à titre provisoire prend fin.
3 Le Conseil fédéral notifie aux Etats contractants la fin de l’application à titre provisoire. Minorité (Forster, Briner, Büttiker, Dettling, Reimann) 1bis Si le Conseil fédéral envisage d’appliquer à titre provisoire un traité international, il en informe sans délai les commissions des deux conseils compétentes en matière de politique extérieure. Le Conseil fédéral leur accorde un délai de 30 jours au moins pour se prononcer. Si la commission d’un conseil s’y déclare opposée, l’application à titre provisoire est rejetée.
