Le projet de révision de la loi sur les cartels, dans la teneur que le Conseil fédéral a soumise au Parlement par son message du 7 novembre 20011, est complété comme suit:

Art. 42a Enquêtes lors de procédures engagées au titre de l’accord sur le trafic aérien entre la Suisse et la CE

1 La Commission de la concurrence est l’autorité suisse compétente pour collaborer avec les institutions de la Communauté européenne au titre de l’art. 11 de l’accord entre la Communauté européenne et la Confédération suisse sur le transport aérien2.

2 Si, lors d’une procédure engagée en vertu de l’art. 11 de l’accord sur le transport aérien, une entreprise s’oppose à la vérification, des mesures d’enquête au sens de l’art. 42 peuvent être engagées à la demande de la Commission des CE; l’art. 44 est applicable.
