International Trademark Opposition Based on Earlier Swiss Mark, Likelihood of Confusion Found
Legislator-Zusammenfassung
KI-generiertAn opposition was filed against an international trademark registration based on an earlier Swiss trademark. The court excluded the defendant from the proceedings and upheld the opposition, converting the provisional refusal of the international trademark into a definitive refusal. This decision was based on the likelihood of confusion between the two marks, considering their phonetic and conceptual similarities and the nature of the goods they represent. The defendant was ordered to pay the opposing party's costs and attorney fees.
