Opposant/e, PARFUMS CÉLINE S.N.C., 38, Avenue de Montaigne, F-75008 Paris, représenté par Michel Muhlstein, avocat, 17, rue Töpfer, 1206 Genève, Marque internationale n° 650 470 «Magic CÉLINE PARIS» (fig.) contre Défendeur/resse., «ALEN MAK» S.A., 148, rue Vassil-Levski, BG-4003 Plovdiv (Bulgarie), Marque internationale n° 665 540 MAGIC (fig.). L’Institut Fédéral de la Propriété Intellectuelle a, le 4 octobre 2001, décidé:
1. La défenderesse est exclue de la procédure.
2. L’opposition n° 4268 contre la marque internationale n° 665 540 MAGIC (fig.) est rejetée.
3. Le refus provisoire total du 3 juillet 2000 sera retiré dès que la présente décision sera entrée en force.
4. La taxe d’opposition reste acquise à l’Institut.
5. Il n’est pas alloué de dépens.
6. La présente décision est notifiée aux parties, par publication dans la Feuille fédérale pour la partie défenderesse.
Voies de droit La présente décision peut être attaquée par voie de recours dans les 30 jours à dater de sa notification devant la Commission de recours en matière de propriété intellectuelle, Einsteinstrasse 2, 3003 Berne. Les mémoires de recours doivent être présentés en trois exemplaires. Une copie de la décision attaquée est à joindre aux mémoires de recours.
