Décision dans la procédure d’opposition no 8538

Opposante Heraeus Kulzer GmbH, Grünerweg 11, 63450 Hanau (DE), enregistrement international no 795 010 «iBond» contre Défenderesse Shofu, Inc., 11 Kamitakamatsu-cho Fukuine, Higashiyama-ku, Kyoto 605-0983, Japon, enregistrement international no 884 290 «HY-BOND RESIGLASS». L’Institut Fédéral de la Propriété Intellectuelle a décidé le 7 novembre 2007 ce qui suit:

1. L’opposition no 8538 contre l’enregistrement international no 884 290 «HY- BOND RESIGLASS» est rejetée.

2. La taxe d’opposition de 800 francs reste acquise à l’Institut.

3. Aucuns dépens ne sont à allouer aux parties.

4. Quand la présente décision sera entrée en force, il sera émis une déclaration d’acceptation de l’enregistrement international no 884 290 «HY-BOND RESIGLASS»

5. La présente décision est notifiée aux parties, par publication dans la Feuille fédérale pour la partie défenderesse.

Voies de droit: Cette décision peut faire l’objet d’un recours, dans un délai de 30 jours à compter de cette notification, auprès du Tribunal administratif fédéral, 3000 Berne 14. Une copie de la présente décision est à joindre au mémoire de recours.
