Appeal Regarding Suspension of Pre-Trial Detention Visits Deemed Moot
Sintesi Legislator
Generato dall'IAAn appeal was lodged against a prosecutor's decision that temporarily suspended free visits between a defendant, currently in pre-trial detention for aggravated drug offenses, and his wife. The court determined the appeal was moot because the prosecutor subsequently issued a new decision on the date of the appeal, which reinstated visits, albeit provisionally supervised and recorded, pending further investigation, and the appellant's challenge was solely directed at the original, superseded order. Consequently, the appeal was struck from the rolls without judicial fees or costs, while preserving the right to challenge the later decision.
