Appeal Mooted by Dropped Charges; Costs Awarded
Sintesi Legislator
Generato dall'IAA party filed an appeal challenging a public prosecutor's decision regarding access to case files, but the appeal was rendered moot because the prosecutor subsequently issued a decision to drop the charges against the accused. The court determined that the appeal itself was not unfounded and should have been granted considering the procedural stage and the lack of valid grounds to deny full access to the case file, therefore ordering the state to reimburse the appellant a specified amount for costs, noting this amount would be factored into any future final fee award should legal aid be granted.

__________
sedente per statuire sul reclamo
31 marzo 2000 formulato da
__________
(patrocinato dall'avv. __________)
contro la decisione 21/22 marzo 2000 del Procuratore Pubblico avv. __________ in ambito di accesso agli atti;
lette le osservazioni 6 aprile 2000 del PP con cui si chiede la reiezione dell'impugnativa;
considerato come nelle more della procedura il magistrato d'accusa ha emanato un decreto di abbandono nei confronti dell'accusato e rilevato come detto decreto d'abbandono rende nella sostanza privo d'oggetto il gravame di cui si tratta;
ritenuto come l'impugnativa non fosse destituita di fondamento, anzi, la stessa avrebbe dovuto essere accolta alla luce dello stadio della procedura e dell'assenza di validi motivi prioritari per opporsi all'esame integrale, si giustifica l'attribuzione al reclamante di un'indennità per ripetibili (osservato come, in caso di concessione del gratuito patrocinio - vista la pendenza dell'istanza 9 dicembre 1999 della difesa - l'importo delle ripetibili sarà computato nella nota d'onorario che verrà ammessa);
P.q.m. visti gli artt. 280 e segg. e gli artt. 157 e segg. nonché 161 e segg. CPP;
decide:
