Appeal Regarding Untimely Request for Further Investigative Measures
Sintesi Legislator
Generato dall'IAA party filed a complaint against a Public Prosecutor's decision that deemed a request for further investigative measures untimely, which had been submitted after the deadline for filing documents following the rejection of a prior extension request for that filing deadline. The court reasoned that since the appeal against the denial of the extension did not have a suspensive effect, the original deadline expired on December 23, 2004, making the subsequent request for supplementary investigation on December 30, 2004, untimely; consequently, the current appeal, now largely moot, was rejected, and associated costs were imposed on the appellant who was aware of the deadline and the pending appeal regarding the extension.

Incarto n.
__________, __________ (rappr. dall'avv. __________, __________) contro
la decisione 3 gennaio 2005 del Procuratore pubblico Giuseppe Muschietti che dichiara intempestiva l'istanza di complemento istruttorio presentata il 30 dicembre 2004 nell'ambito dell'inc. MP __________;
considerata priva d'utilità la trasmissione del reclamo al magistrato inquirente ed alle parti civili, per osservazioni, in virtù di quanto si dirà in seguito;
ritenuto, in fatto ed in diritto, che:
- con decisione del 23 dicembre 2004, il Procuratore pubblico ha respinto la richiesta di proroga del termine di deposito degli atti (su complemento) che giungeva a scadenza a quella stessa data;
- contro tale decisione la difesa di __________ ha inoltrato reclamo (al GIAR) il 30 dicembre 2004 e, contestualmente, ha presentato un'istanza di complemento istruttorio;
- il reclamo contro il rifiuto di concessione di una proroga del termine di deposito degli atti non ha, di per sé, effetto sospensivo, né tale effetto è stato concesso (art. 281 cpv. 2 CPP);
- con decisione del 17 gennaio 2005, questo giudice ha respinto il reclamo contro il rifiuto di concessione della proroga del termine ex art. 196 CPP;
- in virtù di quanto sopra esposto, il termine di deposito degli atti (e di inoltro delle eventuali richieste di complemento istruttorio) risulta essere giunto a scadenza il 23 dicembre 2004 e non prorogato;
- la richiesta del 30 dicembre 2004 è, quindi, intempestiva e non può essere considerata come inoltrata nell'ambito di una proroga del termine in questione;
- il reclamo, attualmente anche privo d'oggetto, deve pertanto essere respinto;
- la tassa di giustizia e le spese, possono essere poste a carico del reclamante cui era nota la scadenza del termine ed il fatto che la proroga era sub giudice.
