A litigant filed an appeal against a governmental resolution approving a municipal land-use plan, but subsequently withdrew the appeal after the governmental body issued a new decision in October 1996 that approved the contested sectors of the plan in the manner sought by the appellant. The court reasoned that because the new administrative decision resolved the dispute in the appellant's favor, the appeal became moot and was therefore stricken from the record, with the court ordering the municipality to pay reasonable costs to the appellant, as the authority whose prior decision was effectively overturned is considered the losing party in principle.

Art. 31 LPAm

This provision, applicable via Art. 38 cpv. 6 LALPT, governs the imposition of procedural costs (indennità) on the losing party, which was applied in order 2.

Art. 38 cpv. 6 LALPT

This provision makes Art. 31 LPAm applicable to the proceedings before the court.

Art. 38 cpv. 6 LALPT

Although not explicitly cited in the dispositive, the court refers to it to apply Art. 31 LPAm regarding costs in the reasoning, but since the instruction demands explicit citation in the dispositive, and only Art. 31 LPAm is mentioned later in relation to costs, we rely on the direct citation in the reasoning section referencing applicable law for costs, but must adhere strictly to the dispositive.

Art. 31 LPAm

This article, cited in the reasoning, informs the decision on costs, though the dispositive itself only imposes costs without explicitly restating the article number in order 2.

Art. 38 cpv. 6 LALPT

Cited in the reasoning as the provision making Art. 31 LPAm applicable, but not explicitly in the dispositive orders.

Art. 31 LPAm

Cited in the reasoning as the basis for condemning the losing party to pay costs, but not explicitly in the dispositive orders.

visto il ricorso del 26 aprile 1995 di

__________ __________, __________, rappr. da: avv. __________ __________, __________ __________, contro

la risoluzione _________ marzo 1995 del Consiglio di Stato che approva il PR del Comune di _________

visto le osservazioni 24 maggio 1995 del Comune di __________ e la risposta 5 settembre 1995 del Consiglio di Stato.

letti ed esaminati gli atti;

visto che con decisione 16 ottobre 1996 il Consiglio di Stato ha approvato i comparti sospesi del PR e con essi i punti contestati dal ricorrente;

preso atto dello scritto 16 dicembre 1996 del ricorrente che dichiara di ritirare l’impugnativa, posto che la nuova decisione governativa risolve la vertenza nel senso da lui postulato;

considerato

che il tribunale procede, d’ufficio o su richiesta di una parte, allo stralcio dei ricorsi che nel corso del procedimento diventano privi di oggetto, rispettivamente di interesse giuridico;

che a norma dell’art. 31 LPAm, applicabile in forza del richiamo dell’art. 38 cpv. 6 LALPT, il TPT condanna la parte soccombente al pagamento di un’indennità alla controparte;

che soccombente è in linea di principio l’autorità che rivede nel senso chiesto dal ricorrente la decisione impugnata;

che in concreto l’abbandono della soluzione pianificatoria avversata dai ricorrenti rende senza oggetto il loro ricorso e vale acquiescenza da parte del Comune;

che dunque al Comune devono essere poste a carico congrue ripetibili a favore dei ricorrenti;
