Appeal Moot Due to Revised Zoning Plan Approval
Sintesi Legislator
Generato dall'IAA challenge was brought against a state council decision approving a municipality's zoning plan; however, the state council subsequently approved a revised zoning plan in 2002, which expressly repealed the previously contested resolution, rendering the appeal moot. The court informed the appellant that the case would be removed from the docket without costs or the awarding of legal fees, and because the appellant failed to respond or present observations within the specified thirty-day period, the court decreed the removal of the appeal from the records, with no assessment of fees or award of costs.
