Acquittal for Employment Violation Due to Lack of Employer Status and Intent
Sintesi Legislator
Generato dall'IAThe defendant was charged with employing a foreign national without the requisite permit, but the court acquitted the accused because it determined the individual lacked the necessary decision-making power to be considered an employer under the relevant law, further finding that the required element of intent for the offense was absent, as only negligence could potentially be attributed to the defendant, which is not punishable under the specific statute.
