Taxpayer Appeal: Removal of Imputed Income from Expense Reimbursements
Sintesi Legislator
Generato dall'IAA taxpayer appealed an assessment that included an imputed CHF 5,000 annual "other source income" based on substantial reimbursements received from an employer for auto and travel expenses incurred while working as a representative. The Tax Office initially justified the imputation because the reimbursements constituted about a quarter of the salary, but upon review of the appeal and supporting documentation presented at the hearing, the Tax Office conceded that the reimbursements were strictly based on actual, documented costs provided by the taxpayer. Consequently, the court accepted the appeal and overturned the prior decision, ordering the removal of the imputed income, as the reimbursements represented actual expense recovery rather than taxable profit.
