Taxpayer Appeal Regarding Reimbursed Travel Expenses and Remand for Further Investigation
Sintesi Legislator
Generato dall'IATaxpayers appealed the inclusion of CHF 2,500 as income from other sources representing lump-sum reimbursed travel expenses, which was first introduced in an amended tax assessment following a prior appeal, despite previous assessments not including such a recovery stemming from a 1992 company tax audit that applied to a 1990 computation year. The court accepted the appeal because the existing case file was insufficient to rule on the current dispute covering the 1995-1996 computation years, as it was unclear whether the employer made similar expense recoveries and reimbursements to the employee during the relevant tax years or if the employee's duties had changed since 1990, thereby necessitating the annulment of the decision and remand to the tax office for further investigation.

statuendo sul ricorso del 11 dicembre 1997
in materia di: IC/IFD 97/98
presentato da: · __________ e __________ __________, __________ __________ __________ __________,
ritenuto
in fatto ed in diritto
- che con decisione su reclamo del 17 novembre 1997 l'Ufficio di tassazione di __________ ha esposto ai coniugi __________ e __________ __________ un reddito d'altra fonte di fr. 2'500.-- a parziale ripresa delle spese di trasferta, che il datore di lavoro ha rifuso forfetariamente ad __________ __________, peggiorando su questo punto la notifica di tassazione del 15 settembre 1997, che non prevedeva nessuna ripresa a tale titolo;
- che con il presente, tempestivo ricorso i coniugi __________ contestano la ripresa dell'importo di fr. 2'500.-- sulle spese di trasferta che il datore di lavoro rifonde mensilmente ad __________ __________ con un importo globale;
- che la ripresa trae origine dal rapporto della verifica fiscale dell'impresa di costruzioni __________ __________, effettuata nell'aprile del 1992, e al successivo verbale del 13 luglio 1992, con il quale l'impresa accettava la ripresa di parte delle indennità di trasferta e del rimborso spese veicoli ai dipendenti;
- che nelle tassazioni IC/IFD 1993-94 e 1995-96 ad __________ __________ non è stata fatta nessuna ripresa per spese di trasferta rifuse globalmente;
- che tale ripresa è stata effettuata, per la prima volta, nella tassazione IC/IFD 1997-98 in sede di decisione su reclamo;
- che gli atti dell'incarto non consentono a questa Camera di pronunciarsi sulla contestazione;
- che, in effetti, la verifica fiscale dell'impresa __________ __________ si riferisce all'anno di computo 1990, mentre che per la tassazione di __________ __________, qui in contestazione, fanno stato gli anni di computo 1995-96;
- che se, da un lato, la ripresa appare giustificata dal citato rapporto dell'ispettorato fiscale e ancor più dalla lievitazione conosciuta in cinque anni dalla rifusione forfetaria, dall'altro, non risulta né se all'impresa __________ siano state effettuate delle riprese per rifusioni delle spese di trasferta e veicoli ai dipendenti negli anni di computo 1995 e 1996, né se __________ __________ continui a esercitare, nell'ambito dell'impresa, le medesime mansioni che esercitava nel 1990 o se invece esse abbiano conosciuto un'evoluzione;
- - che pertanto gli atti del procedimento devono essere retrocessi all'UT, perché completi gli accertamenti nel senso appena indicato;
Per questi motivi,
visti per le spese gli art. 144 LIFD e 231 LT 1994 dichiara e pronuncia
146 LIFD).
