Taxpayer Appeal on Retroactive Married-Couple Tax Rate Dismissed for Untimely Challenge to Intermediate Ruling
Sintesi Legislator
Generato dall'IAA taxpayer appealed an income and wealth tax assessment for 1995-96, seeking the application of the married-couple tax rate retroactive to the date of marriage in April 1995, having previously filed a rejected request for intermediate taxation based on the same ground. The tax office had previously rejected the intermediate taxation request because marriage was not a legally stipulated cause for such taxation, and subsequently rejected the formal appeal against the ordinary assessment. The court dismissed the appeal because the decision denying the intermediate taxation, issued in May 1996, was not formally challenged within the thirty-day deadline, and the current appeal only contested the subsequent decision regarding the ordinary assessment; therefore, the appeal was struck from the roll without a ruling on the merits of the tax rate change.

statuendo sul ricorso del 26 luglio 1996
in materia di: IC/IFD 95/96
presentato da: · __________ __________, __________ __________, rappr. da: __________ __________ __________, __________ __________,
ritenuto
1. Il
26 febbraio 1996 l' Ufficio di tassazione di Lugano-Città notificava a __________ __________ la tassazione IC/IFD 1995-96, in cui stabiliva il reddito imponibile in fr. 83'926.-- e la sostanza in fr. 72'837.--.
L'
146 LIFD).
